SUPPLEMENTARY TERMS – VIRTUAL GOODS AND VIRTUAL CURRENCY
Please note that use of PLAYERUNKNOWN’S BATTLEGROUNDS MOBILE is governed by our EULA (available here). You agree to comply with the terms of the EULA when using PLAYERUNKNOWN’S BATTLEGROUNDS MOBILE.
In addition to our EULA, these terms and conditions (“Terms”) apply to any purchase of Virtual Goods and/or Virtual Currency you make from us if you are resident in the European Union or the UK. By purchasing Virtual Goods and/or Virtual Currency from us, you are agreeing to be bound by these terms between you and PROXIMA BETA PTE.LIMITED, a Singapore corporation with its registered office at 10 ANSON ROAD #21-07 INTERNATIONAL PLAZA, SINGAPORE, company registration number 201632879R (“we”, “our” and “us”).
When certain words and phrases are used in these Terms, they have specific meanings (these are known as "defined terms"). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used, it has the meaning given to it in the EULA or, if it is not defined in the EULA, in section of these Terms where it is defined (you can find these meanings by looking at the sentence where the defined term is included in brackets and speech marks).
VIRTUAL GOODS AND VIRTUAL CURRENCY
If you are resident in the European Union or the UK, you have a legal right to cancel your purchase of Virtual Goods and/or Virtual Currency within 14 days of your purchase (the “Cooling-off Period”) without giving any reasons.
If you are resident in the European Union or the UK and you wish to exercise your right to cancel set out above, you must contact us to let us know that you are doing so by an unequivocal statement (e.g. letter sent by email). The easiest way to do this is to contact using the following contact details help@midasbuy.com
before the Cooling-off Period has expired. You may also do this by completing the following model cancellation form below and returning it by email to us at help@midasbuy.com or by post:
We will send you acknowledgement of receipt by email.
If you are resident in the European Union or the UK and you exercise the right to cancel set out above, the contract between you and us for the purchase of the Virtual Goods and/or Virtual Currency (the “Contract”) will come to an end and we will reimburse you all payments received from you for the Virtual Goods and/or Virtual Currency. We will make this reimbursement no later than 14 days after the day on which we are informed about your decision to cancel the Contract. We will make the reimbursement using the same means of payment you use to pay for the Virtual Goods and/or Virtual Currency, unless you expressly agree otherwise.
Where you purchase Virtual Goods and/or Virtual Currency from us and you are resident in the European Union or the UK, the following will apply:
- prior to entering into a contract with us for the provision by us of such Virtual Goods and/or Virtual Currency, we will ask you to confirm that: (A) you wish to be provided with such Virtual Goods and/or Virtual Currency immediately on purchase; and (B) by providing such confirmation you waive your right to cancel under applicable law; and
- accordingly, by providing such confirmation you will waive your right to cancel your purchase of such Virtual Goods and/or Virtual Currency under applicable law.
GOVERNING LAW AND DISPUTE RESOLUTION
The “Governing Law and Dispute Resolution” provisions of the EULA will also apply to these Terms.
